1. Who we are and what this website does

Floating After Five Photography (“we”, “us”) is the photography brand operated by Richard Dang. Contact: floatingafterfive@gmail.com. We offer event, candid, portrait and property/listing photography only in Toronto, Ontario. This website provides information and lets you request pricing. It has no online checkout, automatic booking, accounts or subscriptions.

You may browse without entering a services contract. A person entering a separate services agreement must have legal capacity to do so and, if acting for an organization, authority to bind it. A parent or legal guardian should arrange services for a minor.

2. A quote request is not a booking

Submitting the quote form is only a request for a quote. It does not guarantee availability, reserve a date or time, create a photographer-client relationship or binding photography services agreement, or oblige us to perform services. A submission confirmation acknowledges your request only.

Any booking must be confirmed through our separate photography services agreement and booking process. Any applicable deposit and booking confirmation conditions are addressed in your separate services agreement. Sending this form does not pay a deposit or satisfy those conditions.

3. Pricing and quotes

Quotes depend on the scope, date, location and other details you supply. Please provide accurate information. If those details change before agreement, we may provide a revised quote. Once contracted, changes and additional work require agreement and remain subject to applicable consumer protections. We do not impose undisclosed charges through these Website Terms.

The separate quote and services agreement should identify the price, currency, applicable taxes, payment terms and any agreed additional charges. No standard quote expiry is established by these Terms; any validity period must appear in the particular quote. Website descriptions of turnaround, image counts and deposits should be confirmed for your assignment in that agreement.

4. Using the website

You may use the website to learn about services and make genuine inquiries. Do not submit unlawful, abusive or misleading content, impersonate others, disclose personal information you have no authority to share, attempt unauthorized access, introduce malicious code, or interfere with availability or security. Automated scraping or bulk extraction that infringes rights, collects personal information without authority, or disrupts the site is prohibited.

5. Photographs and other intellectual property

Website text, photographs, graphics, logos and the Floating After Five branding belong to us or their respective rights holders. Viewing the site does not grant a licence to reproduce, publish, sell or use them in advertising. Some service illustrations are third-party Unsplash images, not examples of our completed assignments. Rights permitted by law remain available. Copyright and your licence for photographs commissioned from us are addressed in a separate services agreement.

6. Third-party services and links

The site uses third-party hosting, email delivery, fonts and image delivery. Third-party websites linked here operate under their own terms and privacy practices. We do not control their content or guarantee their availability. Our responsibility for personal information entrusted to service providers is addressed in our Privacy Policy.

7. Website information and responsibility

We aim to keep information accurate and the website available, but errors, interruptions and changes can occur. General website information is not a guarantee of availability or a substitute for the agreed assignment details. Please contact us about an error before relying on it to arrange a shoot.

To the maximum extent permitted by applicable law, we are not responsible for indirect losses from website interruptions or reliance on general website information that were not reasonably foreseeable. This clause does not exclude liability for fraud, wilful misconduct, or liability that cannot lawfully be limited. It does not limit our obligations under a separate services agreement.

Nothing in these Terms waives non-waivable rights or remedies under Ontario consumer protection legislation or other applicable law. There is no mandatory arbitration or class-action waiver.

8. Ontario law and disputes

Ontario law and the federal laws of Canada applicable in Ontario govern these Terms. Subject to any mandatory rights concerning forum or jurisdiction, disputes may be brought before courts with jurisdiction in Toronto, Ontario. You retain access to statutory complaint processes and remedies.

9. General terms and updates

These Terms are the entire statement of terms for website use; separate services agreements govern paid assignments. If a provision is unenforceable, the remaining provisions continue so far as legally possible. A failure to enforce a provision is not a waiver. We may update these Terms by posting a revised version and date for future website use. Changes do not retroactively alter a services agreement or remove accrued rights.
